Order Albert T. Caples, a pro se Kentucky prisoner, appeals the denial of his petition for a writ of habeas corpus filed under 28 U.S.C. § 2254. This case has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit. Upon examination, this panel unanimously agrees that oral argument is not needed. Fed. R. App. P. 34(a). Following a jury trial in the Jefferson County, Kentucky, Circuit Court in August 1982, Caples was convicted of burglary, receiving stolen property, and of being a persistent felon and was sentenced to 30 years imprisonment. Caple's convictions were affirmed by the Kentucky Supreme Court on direct appeal. Thereafter, a motion for post-conviction relief was denied by the trial court. The Kentucky Court of Appeals affirmed the denial and the Kentucky Supreme Court denied a petition for discretionary review.
